Early Access Program Terms

Last Modified: August 31st 2026 We appreciate your involvement in the Equator IT Early Access Program. The following terms (“Terms”) oversee your engagement in any of the public or private Early Access initiatives (“Early Access Program”) and your utilization of Equator IT’s Early Access features (“Early Access Services”). To partake in a Early Access Program or to use the Early Access Services, you must accept these conditions.
1. Eligibility and Participation
By using the Equator IT Early Access Services, you commit to adhering to the stipulations outlined in these terms by Equator IT concerning these Early Access Services. Furthermore, you consent to operate the Early Access Services in line with EDMISS Customer Terms of Service, Product Specific Terms, and EDMISS Acceptable Use Policy (collectively referred to as the “Terms of Service”) throughout the duration of these terms. The EDMISS Customer Terms of Service are included by reference and will prevail for any clauses not specified in these terms. The Terms of Service remain in effect concerning your utilization of Equator IT Services or any Early Access Services. Should you cease to be an EDMISS user, your access to all Early Access Services will be revoked.
2. Early Access Services

 “Early Access Services” means a Service, or a feature of a Service, that is designated or presented to the user as alpha, Early Access, experimental, pilot, limited release, in development, developer preview, early access, non-production, evaluation, such that it is provided prior to general commercial release (and can have the designation “Early Access”).

 By accepting these Terms or using the Early Access Services, you understand and acknowledge that the Early Access Services are being provided on an “As Is” or “As Available” basis. The Early Access Services may contain bugs, errors, and other problems. YOU ASSUME ALL RISKS AND ALL COSTS ASSOCIATED WITH YOUR USE OF THE Early Access SERVICES. In addition, we are not obligated to provide any maintenance, technical, or other support for the Early Access Services.
3. Feedback
 The Early Access Services are provided to you for assessment and feedback purposes, and no compensation or reimbursement will be offered by Equator IT (“Feedback”). You recognize the significance of maintaining open communication with Equator IT while using the Early Access Services and commit to accepting relevant communications and updates from us about the Early Access Services. Should you choose to unsubscribe from such communications, Equator IT has the authority to end your involvement in the Early Access Program, leading to the discontinuation of your access to the relevant Early Access Services.  When using the Early Access Services, you’ll be prompted to share feedback on your experience. All feedback you provide is owned by Equator IT. If necessary, you provide us with an everlasting, irrevocable, royalty-free global license to utilize or integrate this feedback into any of our products or services at our discretion. Should we opt to share this feedback, it will be done anonymously, or we will request your permission if identification is desired.

 Additionally, we may observe your usage of the Early Access Services and utilize this data to enhance the Early Access Services or our other offerings.

4. Intellectual Property
 Except to the extent permitted by law, you agree not to modify, distribute, prepare derivative works of, reverse engineer, reverse assemble, disassemble, decompile or otherwise attempt to decipher any code in connection with the Early Access Services and/or any other aspect of EDMISS technology.
5. Modification and Termination
 Equator IT holds the authority to alter, conclude, or limit your access to the Early Access Services or the Early Access Program at any moment, based on our sole judgment, for any reason, with or without prior notification, and without liability to you. If you continue using the Early Access Services after any modifications to these Terms, your usage will be deemed as an acknowledgment of the revised Terms.  As long as you utilize the Early Access Services, these terms will be applicable until they are made widely available to the public (General Availability or “GA”). Any violation on your part, including breaching confidentiality obligations, will lead to the automatic termination of these Terms. Any non-compliance with the Agreement can result in an immediate cessation of your access to other Early Access Services or Equator IT Services.
6. Warranty

 Equator IT makes no warranties, express or implied, guarantees or conditions with respect to the Early Access Services or your use of them. You understand that use of the Early Access Services is at your own risk and that we provide the Early Access Services on an “as is” basis “with all faults” and “as available.” You bear the entire risk of using the Early Access Services.

7. Confidential Information

 You acknowledge and agree that: (i) both the Early Access Program and Early Access Services are deemed Confidential Information as outlined in the Customer Terms of Service; (ii) the successful market introduction of the commercial iterations of the Early Access Services, requires you to maintain the confidentiality of all EDMISS data and details, whether discussed, accessed through, or embedded in the Early Access Program, including but not limited to the Early Access Services; (iii) any untimely disclosure of the Confidential Information could adversely impact Equator IT’s competitive edge and intellectual property interests; and (iv) details concerning the Early Access Services must not be disseminated to anyone, except other authorized Early Access Services users, which might encompass users within your EDMISS subscription.

8. Compliance with Laws
You agree to comply with all applicable local, state, national, and foreign laws, rules, and regulations, including, but not limited to, all applicable import and export laws and regulations governing use, transmission and/or communication of content, in connection with their performance, participation, access and/or use of the Early Access Services or Early Access Program.
